Please read these Terms of Service ("Terms", "Terms of Service") carefully before using the 1794 mobile application (the "Service") operated by 1794 ("we", "us", or "our").

1. Acceptance of Terms

By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the terms, then you may not access the Service.

2. Description of Service

1794 is a mobile application designed to help users:

  • Make predictions for football matches
  • Track prediction accuracy and performance
  • Organize and follow favorite teams, leagues, and matches
  • Earn achievements based on prediction activity and accuracy
  • Access educational content about match analysis
  • Store personal notes and analysis locally on their device

3. User Accounts and Data

The Service does not require user account creation. All user data, including predictions, notes, favorites, and statistics, is stored locally on your device. You are responsible for:

  • Maintaining the security of your device
  • All activities that occur on your device
  • Backing up your data if desired

4. Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree NOT to:

  • Use the Service for any illegal or unauthorized purpose
  • Attempt to gain unauthorized access to any portion of the Service
  • Reverse engineer, decompile, or disassemble the application
  • Remove, circumvent, disable, damage or otherwise interfere with security-related features
  • Use any automated system to access the Service
  • Transmit any viruses, malware, or other malicious code
  • Collect or harvest any information from the Service or other users
  • Use the Service to harass, abuse, or harm another person

5. Intellectual Property Rights

The Service and its original content (excluding match data from third-party providers), features, and functionality are and will remain the exclusive property of 1794. The Service is protected by copyright, trademark, and other laws. Our trademarks may not be used in connection with any product or service without our prior written consent.

6. Third-Party Data and Services

The Service uses match data provided by API-Football and may use other third-party services. We do not guarantee the accuracy, completeness, or timeliness of this data. The use of third-party data is subject to the respective third-party's terms of service and privacy policies.

The Service may contain links to third-party websites or services that are not owned or controlled by us. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party websites or services.

7. No Betting or Gambling

The Service is designed for educational and entertainment purposes only. The Service:

  • Does NOT facilitate betting or gambling of any kind
  • Does NOT involve real money transactions related to predictions
  • Does NOT provide betting odds or gambling advice
  • Should NOT be used as the sole basis for any betting or gambling decisions

Users are solely responsible for complying with local laws regarding sports betting and gambling in their jurisdiction.

8. Accuracy of Information

While we strive to provide accurate match data and educational content, we make no warranties or representations about:

  • The accuracy or completeness of match data
  • The timeliness of updates
  • The reliability of predictions made by users
  • The effectiveness of strategies discussed in educational content

Match data is provided "as is" and "as available" without any warranties of any kind.

9. User-Generated Content

Users may create predictions, notes, and analysis within the app. All such content:

  • Is stored locally on the user's device
  • Remains the property of the user
  • Is not transmitted to our servers
  • Is not accessible to other users or to us

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

  • The Service will function uninterrupted, secure, or available at any particular time or location
  • Any errors or defects will be corrected
  • The Service is free of viruses or other harmful components
  • The results of using the Service will meet your requirements

11. Limitation of Liability

IN NO EVENT SHALL 1794, NOR ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES, BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

  • Your access to or use of or inability to access or use the Service
  • Any conduct or content of any third party on the Service
  • Any content obtained from the Service
  • Unauthorized access, use, or alteration of your transmissions or content
  • Any decisions made based on match data or predictions

12. Indemnification

You agree to defend, indemnify, and hold harmless 1794 and its licensors, employees, contractors, agents, officers, and directors from and against any claims, damages, obligations, losses, liabilities, costs, or debt, and expenses arising from:

  • Your use of and access to the Service
  • Your violation of any term of these Terms
  • Your violation of any third-party right, including intellectual property rights
  • Any harm caused to any third party through your use of the Service

13. Changes to Service

We reserve the right to withdraw or amend our Service, and any service or material we provide via the Service, in our sole discretion without notice. We will not be liable if for any reason all or any part of the Service is unavailable at any time or for any period.

14. Modifications to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our Service after any revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you are no longer authorized to use the Service.

15. Termination

We may terminate or suspend your access to the Service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever, including without limitation if you breach these Terms.

Upon termination, your right to use the Service will immediately cease. If you wish to terminate your use of the Service, you may simply discontinue using the Service and uninstall the application.

16. Age Restrictions

The Service is intended for users who are at least 13 years of age. By using the Service, you represent and warrant that you are at least 13 years old. If you are under 13 years of age, you may not use the Service.

17. Governing Law

These Terms shall be governed and construed in accordance with the laws of the applicable jurisdiction, without regard to its conflict of law provisions.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.

18. Entire Agreement

These Terms constitute the entire agreement between you and 1794 regarding the use of the Service, superseding any prior agreements between you and us relating to the Service.

19. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that these Terms will otherwise remain in full force and effect and enforceable.

20. Waiver

No waiver of any term of these Terms shall be deemed a further or continuing waiver of such term or any other term, and our failure to assert any right or provision under these Terms shall not constitute a waiver of such right or provision.

21. Assignment

You may not assign or transfer these Terms, by operation of law or otherwise, without our prior written consent. Any attempt by you to assign or transfer these Terms without such consent will be null and void. We may freely assign or transfer these Terms without restriction.

22. Force Majeure

We shall not be held liable for any delays or failures in performance resulting from acts beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, network infrastructure failures, strikes, or shortages of transportation facilities, fuel, energy, labor, or materials.
